1. Agreement and scope
These Terms of Use ("Terms") govern access to and use of https://playtgba.com, related league-management services, and participation in The Gamers Basketball Association (collectively, the "Services"). The Services are owned and operated by Cresium Capital Partners LLC, doing business as The Gamers Basketball Association ("TGBA," "we," "us," or "our").
By creating an account or using an authenticated part of the Services, you agree to these Terms. You also agree to comply with the current TGBA Code of Conduct, Eligibility acknowledgment, unofficial-product disclaimer, public profile and evidence notice, applicable Season rules, published competition rules, and other policies expressly incorporated into these Terms. If you do not agree, do not create an account or use the authenticated Services.
The Privacy Policy explains how TGBA collects, uses, shares, retains, and protects information. It is incorporated by reference for notice purposes.
Acceptance is recorded on this website when you check the required boxes and create an account. TGBA does not use downloaded forms or wet signatures for Season One registration.
2. Eligibility
TGBA Season One is limited to people who are at least 18 years old. You must truthfully certify that you are 18 or older when registering. TGBA records the date and version of that certification but does not collect your date of birth for Season One.
You may not register or participate if:
- you are under 18;
- you are legally prohibited from using the Services;
- your TGBA account has been suspended or deactivated and TGBA has not authorized your return; or
- you are currently ineligible under a TGBA eligibility or disciplinary decision.
Season One does not require government identification. Do not send a driver's license, passport, or other government ID. If TGBA ever uses an exceptional identity-document process, it will give a separate notice before collecting any such document.
3. Accounts and verification
Every participant must have an individual, verified TGBA account, including players who already belong to an established Crew or friend group. Accounts may not be shared, transferred, sold, or used by another person.
You agree to provide accurate account information, maintain the security of your credentials, and notify support@playtgba.com promptly if you believe your account has been compromised. Your login email is private and will not be displayed in public player or free-agent profiles.
A TGBA website account is separate from your NBA 2K Account, PlayStation Network account, Microsoft/Xbox account, and other third-party accounts. You remain responsible for complying with the terms that govern those services.
4. Two ways to enter the league
TGBA supports both organized groups and individual players.
4.1 Existing Crews and friend groups
A captain may submit a franchise application for an established group. Approval of an application does not automatically register the group's players. Every proposed player must create and verify an individual account, accept the current legal documents and policies, receive a roster invitation, and accept that invitation before becoming rostered.
TGBA may approve, reject, waitlist, or request changes to a franchise application. Application does not guarantee acceptance into a season.
4.2 Individual free agents
An individual may opt into the TGBA free-agent pool. A free-agent profile may display the individual's chosen public name, gamertag, platform, basketball positions, general availability, time zone, and recruiting status. Login email, private notes, and other private account data will not be shown publicly.
Captains may invite eligible registered free agents to their franchise. A free agent is not rostered until the invitation is accepted and all eligibility checks pass. TGBA does not guarantee that any free agent will receive an invitation, make a roster, play a minimum number of games, or be compatible with teammates.
TGBA does not conduct background checks on participants and does not guarantee any participant's identity, statements, conduct, skill, or availability. Use good judgment when communicating with people you meet through TGBA, do not disclose sensitive personal information unnecessarily, and report threatening or abusive conduct.
5. Rosters and participation
A person may represent only one TGBA franchise during the applicable roster period. For Season One, the same roster period covers the regular season, Association Cup, and playoffs.
To appear in an official game, a player must, before the applicable deadline:
- have a verified TGBA account;
- have accepted the current required legal documents and policies;
- have a valid current gamertag claim for the platform used;
- be eligible to participate;
- be an accepted member of that franchise's roster for the current roster period; and
- satisfy any additional published competition requirements.
Being listed in a franchise application, group chat, Discord server, or NBA 2K Crew does not by itself make someone eligible for a TGBA game. Captains are responsible for checking their official TGBA roster before each game.
Roster invitations, acceptances, releases, free-agent signings, and approved exceptions are governed by the current Season rules. TGBA may reject or reverse a transaction that violates eligibility, roster limits, or competitive-integrity requirements.
6. Competition administration
TGBA staff may schedule games, approve or decline reschedules, verify results, resolve disputes, assess forfeits, correct administrative errors, impose discipline, and interpret published rules. Staff decisions must be based on the applicable rules, available evidence, and assigned permissions. Material actions are recorded in administrative audit logs.
Game submissions and supporting evidence do not become official merely because a captain uploads them. A result becomes authoritative only through TGBA's verification process. If an official result must be corrected, TGBA preserves the earlier submission and records the correction rather than silently rewriting the historical evidence.
Standings, player statistics, awards, brackets, and historical records may be recalculated when an authoritative result is corrected or overturned.
7. Scheduling, attendance, and forfeits
Official Season One windows are published in Eastern Time using the America/New_York time zone so daylight-saving changes are handled correctly. Participants are responsible for checking the displayed date, time, and time-zone label.
Captain reschedules require the opponent's acceptance and staff confirmation unless a published rule states otherwise. A no-show report or missed window is a review candidate, not an automatic forfeit.
Only a final, staff-confirmed, non-overturned forfeit assessed against a franchise counts toward the Season One three-forfeit policy:
1. First counted forfeit: formal warning.
2. Second counted forfeit: franchise probation.
3. Third counted forfeit: franchise removal from Season One.
Pending, rejected, disputed, superseded, or overturned forfeits do not count. Outages or other events classified as no-contests do not count. Removal preserves completed games and league history; remaining games are handled individually by staff under the Season rules and are not automatically converted into verified forfeits.
8. Player statistics and league history
TGBA may publish and retain competition information such as public display names, gamertags, franchise membership, game participation, scores, statistics, standings, transactions, awards, and historical records.
TGBA may publish a final eligibility, roster, standings, or safety status when that status is necessary for eligibility, rosters, standings, or safety (for example that a player or franchise is ineligible, on probation, or removed). TGBA does not publish allegations, private reports, investigation evidence, or staff notes.
League history is intended to remain accurate across seasons. Deactivating an account does not erase verified game results, roster history, awards, or other records necessary to preserve competition integrity. Where practical, TGBA may disconnect private login information from retained historical records.
9. Submitted content and limited license
You retain whatever ownership rights you hold in original content you submit, such as an original franchise name, logo, biography, announcement, or written statement. You grant Cresium Capital Partners LLC, doing business as TGBA, a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as reasonably necessary to:
- operate and administer the league;
- identify franchises and participants;
- publish schedules, standings, statistics, awards, and historical records;
- investigate disputes and enforce rules; and
- promote TGBA, its seasons, franchises, players, and events.
This license continues for published league history and archival records after you leave the league. You represent that you have the right to submit the content and that TGBA's permitted use will not knowingly violate another person's rights.
Do not submit NBA, WNBA, NBA G League, NBA 2K League, NBA team, 2K, Take-Two, PlayStation, Xbox, or other third-party logos as though they were your franchise's original identity. TGBA may reject or remove content that creates confusion, infringes rights, or exposes the league to a credible complaint.
10. Screenshots and game evidence
Captains and authorized participants may submit final-score screens, box-score screens, and related evidence. Such submissions may contain gamertags, in-game avatars, game interface elements, scores, statistics, chat excerpts, and other information relevant to league administration.
Evidence is private by default. Access is limited to authorized TGBA staff and, when applicable, captains or co-captains of the franchises involved in the game or dispute. Screenshot file paths and private evidence are not public standings data. TGBA may use evidence to verify results, resolve disputes, investigate misconduct, rebuild official records, and defend the integrity of a decision.
TGBA will not use private evidence as general promotional content without a separate review and an appropriate legal basis or permission. You should crop or exclude unrelated personal information whenever reasonably possible.
11. Acceptable use
You may not use the Services to:
- harass, threaten, stalk, dox, discriminate against, or exploit another person;
- impersonate another person or misrepresent eligibility, identity, roster status, or authority;
- cheat, use prohibited scripts or unauthorized software, manipulate gameplay, falsify statistics, fabricate evidence, or interfere with an investigation;
- gain unauthorized access to accounts, records, administrative functions, or private evidence;
- upload malware or exploit a vulnerability;
- scrape, sell, or misuse participant information;
- infringe intellectual-property, privacy, publicity, or other rights;
- arrange match fixing, bribery, or wagering that compromises TGBA competition; or
- use TGBA branding or communications to falsely imply official NBA, WNBA, NBA G League, 2K, Take-Two, PlayStation, or Xbox affiliation.
The Code of Conduct provides additional behavioral and enforcement rules.
12. Third-party services and intellectual property
TGBA is an independent community league. It is not affiliated with, endorsed by, sponsored by, or administered by the National Basketball Association, NBA Properties, WNBA, NBA G League, NBA 2K League, 2K, Take-Two Interactive, Sony Interactive Entertainment, or Microsoft.
NBA, WNBA, NBA G League, NBA team names and marks, NBA 2K, 2K, Take-Two, PlayStation, Xbox, and related names, game content, logos, and marks belong to their respective owners. References to NBA 2K27 and compatible platforms identify the game and services used by participants; they do not indicate sponsorship or approval.
Your ability to play depends on third-party hardware, software, accounts, subscriptions, servers, network access, and rules. TGBA does not control and is not responsible for third-party outages, bans, changes, purchases, subscriptions, or account decisions.
13. Availability and changes
TGBA may modify, suspend, or discontinue features; change schedules or competition formats before they are locked; correct errors; and perform maintenance. We will use reasonable efforts to announce material changes. We do not promise uninterrupted or error-free operation.
Season One is a pilot. Entry is free. No prize, payment, sponsorship, or fee terms are included in this version. TGBA must publish additional terms before collecting participant funds or offering a paid prize program.
14. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available." TGBA disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. TGBA does not guarantee selection, roster placement, playing time, matchmaking quality, competitive outcome, uninterrupted third-party services, or the conduct of other participants.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, TGBA and Cresium Capital Partners LLC, including authorized volunteers and staff acting within their league roles, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, loss of opportunity, personal disputes, third-party account action, or service interruption arising from the Services.
To the fullest extent permitted by law, the total aggregate liability of TGBA and Cresium Capital Partners LLC for claims arising from the free Season One Services will not exceed the greater of (a) the amount you paid TGBA for the relevant Services during the preceding 12 months or (b) US $50.
This section does not limit liability that cannot legally be limited.
16. Suspension and termination
TGBA may restrict, suspend, or deactivate an account or declare a participant ineligible when reasonably necessary to protect participants, investigate misconduct, enforce rules, comply with law, or preserve competition integrity. When appropriate, TGBA will provide notice and an opportunity to appeal under the Code of Conduct or Season rules. Immediate temporary action may be taken for credible safety, security, fraud, or evidence-integrity concerns.
You may request account deactivation by contacting support@playtgba.com. Deactivation ends login access but does not require TGBA to erase authoritative competition records, audit actions, or evidence retained under the Privacy Policy.
17. Governing law and venue
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws principles. Before filing a claim, you and TGBA agree to attempt in good faith to resolve the matter by written notice to support@playtgba.com.
No arbitration or class-action waiver is included in these Terms. Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court of competent jurisdiction located in Alabama.
18. Changes to these Terms
TGBA may update these Terms. Each published version will have an effective date and version number. Material changes may require a new acknowledgment before continued authenticated use or competition participation. Changes do not retroactively alter an authoritative game result unless the applicable competition rules permit that correction.
